The Nepal Rastra Bank (NRB) has issued a working method for licensed banks and financial organisations to deal with cheque dishonour.
The regulation establishes stricter enforcement actions for dishonored cheque, such as blacklisting the individuals or businesses responsible for the rejected checks. Insufficient funds or account closure may result in legal action for cheque dishonour.
Nepal Rastra Bank released the Cheque Bounce Certified Procedure 2024 on July 10, 2025, outlining the steps involved in bouncing cheque and obtaining certification for the process. We developed this blog in response to our clients’ questions regarding how to bounce cheque.
Your bank handles deposited cheques. If the bank account that issued the cheque is closed or has insufficient funds, your bank is unable to process the payment and shall instead issue a Cheque Return Memo detailing why the cheque was dishonored.
Submit it to the bank that issued cheque
Following receipt of the Cheque Return Memo, you should apply to the bank that issued the cheque and ask them to confirm that the cheque bounced.
In order to deposit the specified amount into the account, the person (drawer) who issued the cheque will receive a cheque bounce notice from the issuing bank within 45 days.
Under Nepal’s regulations concerning bounced cheques, the bank that issued the cheque is mandated to send a notification to the person who wrote it (the drawer).
The notice is sent via mail or email, telling the drawer that the check has bounced and demanding that they deposit the specified amount into their account within 45 days.
The law does not stipulate how this communication should be conducted. It must preserve a record of all communication..
The notification should include:
- Must include the original cheque and the cheque return memo.
- Declare that the cheque was dishonoured.
- Deposit the cheque’s amount within 45 days of receiving the notice.
- The drawer has 45 days from the receipt of the notice to make the payment.
- If they pay within 45 days, the case is resolved.
Wait for Payment
If the drawer who issued the cheque does not deposit the amount due within 45 days, the issuing bank might issue a bounce certificate within three days.
This implies you’ll have to wait 45 days and 3 days for the bounce certificate, a total of 48 days.
The following information should be included in the cheque bounce certified certificate.
- The number of the cheque that bounced.
- The name of the drawee or the person who issued the cheque.
- Name of the company and the individual (drawer) who issued the cheque
- Amount written in Cheque
- The date the cheque was issued.
Making a Police Complaint
If payment is not received within 45 days: Following receipt of a certified Cheque Bounce certificate from the issuing bank.
After receiving a dishonoured cheque, you can file a criminal complaint with the police.
Nepal’s new law requires filing a complaint within one year of the bank confirming the cheque as bounced.
It should be filed with the police department in the jurisdiction where you handed the cheque for payment.
NOTE:
- You have the option to submit a police FIR.
- This needs to be completed within a year of the cheque bouncing.
- When you provide a cheque for payment, the police receive the complaint.
